Baby Broke 2 Teeth at McDonalds in Murphy!!!

Hello Moms,

On October 18TH we visited the McDonalds in Murphy. We normally go to the one off McDermott in Allen, but wanted to try a new place. My sweet 2 1/2 year old was playing with his shoes off (there is a sign posted to remove shoes) and WALKED from the play area to the table and slipped on the slick floor. His front teeth hit the side of the metal chair and 2 broke in half! I can barely type this without crying. He couldn't eat or drink much at all until his dental appointment on Wednesday. We took him to Dr. Lisi in Allen, she is terrific. She said he had to get 2 crowns because the cracks were to close to the nerves. Well, we went ahead and had the crowns done, but it was so tough. They put him completely under and he was staring straight through me and drooling, I NEVER want to go through it again. My husband and I paid $1600 cash and we are trying to get McDonalds to reimburse us. Dr. Lisi said there could be permanent damage to his upper gums but we won't know for sure until later. I know that the floor at Murphy is polished with something different then the McDonalds in Allen. Have any of your children slipped on that floor? I've asked McDonalds to check it, but they are blowing me off. I don't want any other children getting hurt at that McDonalds!! Please let me know what I should do to get some action.

First of all... I am sorry you went through this. We all go through some sort of issue similar at some time or another on public property.

I am NOT a sue happy person and because SO many people who are so SUE happy to get a buck....it makes the process worse for those who are not looking to make their retirement...only a reimbursement much harder.

I have experience with an ex neighbor who sued anybody for anything if she had any chance. Needless to say, after learning this one night when she had had too much to drink at another neighbors house... I NEVER allowed her kids to play at my house and NEVER had them on my property. THe same thing happened with other neighbors as they found out. Everyone was waiting around to be sued for some reason or another. FINALLY the neighbors moved. It is sad but we are in a high end neighborhood and we all figured out how this family got here....through suing everyone....

People like the coffee lady (and my ex neighbor) among many others have totally screwed up the system.

Personally, I would contact the McD's where it happened and would possibly go one more step up. If I had no response...I would write it off.

Kids will be kids and things will happen, unfortuantely...some things that happen are worse than others. Hopefully your little one will recover well and this can be forgotten in time.

I know we have written things off before because it is not worth the time and money to pursue it.....bottom line is the HEALTH and SAFETY of your child. For us...our daughter is our priority vs ..... wasting more valuable time than necessary to be reimbursed.

They have to be insured for this type of stuff....just like if he got hurt at daycare, the daycare is liable for whatever out of pocket expenses you have....same at your home, you are responsible if someone gets hurt on your property....I am not a sue happy person but this is negligent on their part. NO SHOES, ONLY SOCKS, SLIPPERY FLOOR---something does not add up to safety here.

I don't have experience with this personally, but I'd go above the local MD's head. Contact McDonalds corporate if you haven't already. Stress your happiness with their chain in general, but your concern about this particular store. You are not asking for major damages, just reimbursement. In the age of the internet, companies of ANY size need to take care of these types of problems. There was a man on youtube who wrote a song "United Breaks Guitars" or something; it went viral and caused them some problems. I wouldn't be threatening, but hopefully corporate will realize that this is a problem and deal with it, especially if you aren't looking to sue like that stupid coffee lady. Good luck!

I do not think you are being unreasonable to persue being reimbursed for your expenses. It seems that area should have been completely blocked off until it was dry.
I think that is one of the MDs owned by Baibrook. The spelling may be a little off, but you might contact him. They have insurance to cover this sort of thing. 1600.00 is small compaired to what you could be asking for!

It makes my stomach hurt to think of what you and your boy went through. Best wishes.

I'm so sorry about your little one, what a terrible experience.
I've been to that McDonald's and other McDonald's and the floors are super slick I saw a little girl falling on her bottom the other day (the one at Murphy and fm 544), however they had the "wet floor" sign put up to cover their backs in case someone falls (which I think it's ridiculous).
I'm not sure how can you get them to do something other than maybe contacting the local newspaper to get the story out but it's a long shot.
on this same topic, I'm always afraid to death of walking at the Collin Creek's mall new floor, I swear I feel I'm going to fall any minute and break my back, What's with these new places and the floors, it's ok that they're clean but they don't have to be so slippery.
