Does Anyone Know What Happens When Your Ex Does Not File a Response?

My court hearing is tomorrow. My ex did not file his response..does anyone know what happens now?

It's to modify child visitation and reimbursement for the children's medical expenses/school, etc.

What can I do next?

I believe that if he doesn't respond the things that you requested will be granted.

What happens is whatever the judge decides. The judge is in total control of what happens in the courtroom, within the law. The judge can grant your request, or not, or give your ex more time to respond, or not.

I believe in California, you will ultimately get what you want. Did you have a case management hearing today or was it an actually judgement? I'm not sure how it works with modifications but for the divorce process, you have to file additional paperwork (to enter default) before the judge will take any action. Good luck to you - being your own attorney is no fun!

EDIT: It is ultimately up to the judge. But, the precedent in California is to honor your request. If you have his employment information the court can send paperwork to his employer and have the money directly taken out of his pay check (up to 50%).

I believe he loses visitation and they will have to go after him for the expenses. He will have to file again to get visitation.

Don't count on them granting your request. In my paperwork it said if the father didn't fill his info out the other parent would be in favor for everything. They didn't even make it an issue. He lied and said he never got it because he moved. Funny he got everything else. He just would lose it.
