We had constant calls for someone; I started documenting all the calls (time, who, and phone number). Once I finally got someone on the phone; I let them know that
1. The number they are calling for...is wrong due to we've had this number for (fill in how long) and due to the constant harassment and do not know this consumer's whereabouts.
2. Begin to list the times and who has been calling, then from what number
3. Have reported this to the FTC
4. And if they have called before 8am or after 9pm it is illegal.
5. also it is good if they have told you about the consumer's debt add that into your list due to FTC laws it states: The FDCPA generally prohibits the company from providing information about the consumer's debt owed due to you do not know this person's whereabouts, have no relation to said person, and have reported the company to the FTC and calls from this point should cease
Further law states: Section 804(3) prohibits a debt collector contacting a third party for location information 18 from communicating with the person more than once, unless the person requests it or the collector reasonably believes the person’s earlier response was erroneous or incomplete and that the person now has correct or complete location information.
