Hi ok here our dilemma we bought a car for our daughter about a month ago, the lady who sold it to us said her husband was in the middle of getting it painted and she made him stop because she didnt like it, so she said it would still get painted whatever color we want its included with the price, well my husband didnt want to leave the car with them until they got around to it and yes we both were ignorant to not have gotten this in writing or at least pay them 1/2 till it got done, so now we keep calling and calling and get no response from them, I did leave a message nothing yet my husband did talk to her last week and she said oh let get with my husband call me in a few days, well still nothing, so is there something we can still do maybe legally, we cant afford to paint it we have already had to spend well over $500 on this car on top of what we paid for it, please help?

Nothing can be done legally at this point, as the car was taken from their home and you already paid. You basically accepted the car as it was the minute you pulled out, exchanged cash, and put your John Hancock on the papers. NEVER trust anyone with empty promises. If they intend to keep them, then they would have no problem putting it in WRITING for YOUR own piece of mind. The smart thing would have been to leave the car there UNTIL the paint job was finished, THEN pay and drive off. I would be skeptical of any other issues the car may have, as these people seem dishonest and probably didn't disclose any faults. I hope you had a mechanic check it out before buying or you may be in for some other nasty surprises. Try Maaco or maybe some local body shops for the paint. You may end up paying almost as much for the paint as the car is worth though, unfortunately. You may find a neighbor who has a friend who can help or maybe a pro on craigslist who does freelance car painting work on the side from his home.
Legally--They are under no obligation to paint the car because it is not in writing. I would try driving over and having it put in writing, but at this point, I think you need to take it as a loss and a lesson learned. I'm sorry!
Drive over to her house and make her put it in writing. AND learn your lesson for next time :)
When you buy a used car it is "as is" unless stated in writing. If you have already paid and the title is in your name, they are no longer responsible to you for anything regarding the car. I hate to say it, but you should have either gotten it is writing or you should have not paid for the car until the paint job was done. Now I fear you are stuck with what you have.
A verbal agreement (and hopefully a handshake took place) is a contract.
Yes, it would have been prudent to get it in writing.
Call and ask for him to honor his agreement.
The paint job may suck, though, so, if they will not honor their agreement, then write it off as a lesson learned. Your daughter will benefit from this as well.
Also, the "used car" syndrome is rampant these days everywhere.

It sounds like a learning lesson for all of you. If you got nothing in writing I don't think there is much to be done. I am sorry to hear of your being cheated.
Sorry to say that's the chance you take from buying private. There is nothing you can do because you didn't get any guarentee's in writing. You are stuck with it. You can take it to Lakeland and get it painted for $350.00 because our neighbor just got theirs done. Sorry about your luck but at least you learned a lesson.
