Mother Seeking Advice and Support About Custody Battles

I am a 25 yr old mother in a custody battle with my son's father. My son is five yrs old and at the level of a two yr old because of the traveling back and forth. My son leaves 3 times a week to go out to his fathers house which is over an hour away. My sons father and I were never married and I have been in this court battle for three years. I am just at my wit ends with this trial and my attorneys. I guess i just need some advice legally on why this trial has been going on for three years. I live in Chicago and I have to travel out to Kane County for court because the father lives there.

I guess I just need someone to speak with that knows about custody cases and someone who can give me some legal advice. There is alot more to this story but i do not want to talk someones ears off. My son is the only one suffering from this and he will not be able to start Kindergarten in Sept. because of all the traveling back and forth and he will not be able to catch up to the level that he needs to be at. I just need some help and guidance.

I do not have an answer to your questions....I'm sorry. I just wanted to reach out however and say that I hope it all works out. Hang in there for your little guy. When he is old enough to understand, he will appreciate you even more for the great mother you are proving to be.

If this was a court ordered visitation and you want to contest it, call public legal aide at the nearest Child Welfare and Family Services (IDFS) and tell them whats happening and how you would like to proceed without money and get before a judge to state your case.

If that doesn't feel right, then someone is going to have to move. He should not suffer because of you and his Dad... that's the bottom line in my opinion. Somehow he has already fallen victim and has gotten way off track as you describe. He needs to go to kindergarten and when talking to DCFS or IDFS, tell them this visit schedule will now interfere with school. That is a major life event change and should get someone's attention. They might not consider Kindergarten real school, but if he is tested and shown to be special needs, then they might find it necessary for him.

who decided the visitation days??
and who decided the place to handel the court case????

we were on the other side of your situation.

my boyfriend was tring to get custody of his son, because the mother was not taking care of him. And as much as she didn't deserve to have her son...........the court always sides with the mother(in our case that sucked!!!!!!!!!!) But for you its a good thing....know that court will side with you MoRE.....

if you want to talk let me know......

also talk with your lawyer or someone from Public aid and if its affecting your son then they will take his best interest in mind before you or his father.
