HELLO!!!

I have this little problem i am in a month to month so i don't have any lease and i am moving ,the manager of the apartments first told me i can not move now until august 31st b/c i have a lease and i explain to them i DON'T have any lease and then she told me it doesn't matter if you have a lease or not you have to give at least 30 day moving out notice otherwise you have to pay for the extra-days
is that true?
hope somebody can help me

Read your original lease. Even though the term of the lease has expired, it should have language in it that addresses the automatic renewal and notice of termination. We have a rental house and use a standard lease agreement. It states that the lease automatically renews on a month-to-month basis until written notice of termination is given by either party, and that the termination is effective 30 days after notice is given. You may have to give 30 days notice, but it seems like 30 days from now would be August 6th, not August 31st. Just read over your lease and be sure to give the notice in writing. Good luck!

in my experience if you are in a month to month then you do give 30 days notice...did you have a lease in the beginning? what kind of signed paperwork do you have, the rules should be clear in whatever documentation you have, if there's not any either side will have a hard time presenting evidence either way.

G. - Check with teh Greater Dallas Apartment Association or TAA Texas Apartment Association. If really depends on the management company. You may want to call them directly - and ask not using your name or complex just ask about their policy if you can.

I have always herad that you do have to give a 30 day move out notice, it's because the complex has to have adequate time to find a replacement for the rent money they will be losing on a sudden move-out.

At my complex, which I have a year lease, I have to give a 60 day move out notice.

But I agree with the other mom, 30 days from a notice is way before the end of August. Whatever you do, give it in writing with a date on it, so they can't weasel out of it.

I don't know much about the law, I am sure some of you moms out there do, but if it isn't in writing, it isn't so. Or at least thats what I have always understood.
