Section 125 Day Care Account

My husband has money left in this account from before I resigned from my job and needed fulltime day care, so I want to use it up by end of 2011. I looked into a home day care for my toddler to go once a week. The woman said she would give me a receipt but has never done it before and didn't seem to know what I was referring to. Would her SSN be acceptable? Thanks

What can I do next?

Is this a reimbursement account? There is often a form from them for the provider to sign? Not always (I wish it was more standarized!).

I would make sure you get a reciept from her. You just need some sort of statement of payments from her. In this day and age of computer programs of all sorts for recordkeeping, this should not be a such a big deal, I would think? I am able to go into a specialized program I use for my home childcare and just print a wide variety of things for my clients.

You need to be sure you BOTH are claiming this same amount for the time period. If she "doctors" the form (not saying thats what you are doing...I am just speaking in general here, so please don't be offended), so you can get the rest of your money out...then she needs to claim that as income and pay the taxes on it..plus its illegal to do that unless she actually got paid that money, etc.

Usually the forms you have want a signature, or at least the providers name and either SS # or their EIN, if they have one of those (I do the EIN so I am not handing out my SS# all over the place. Its free and quick to do online...you could tell her that!)

Good luck!

I don't know too much about this, but if she isn't a LICENSED home daycare, I don't think that gets covered... I'd look into it, especially since she doesn't know, that's kind of a red flag right there.

I am unlicensed and all I did was fill out a form every six months and provide my SS#. As for poster below I had no clue about this program until this parent brought me the info. Just because she is unaware of the program does mean she can't take part in it.

Good Luck!

If this is a dependant care account like an FSA, her social and signature shuld be enough. I had to submit my claim form with my sister's signature when she watched my kids for a few days. I would call the company that administers the plan. With the one we have, i can also send my kids to day camp or an out of school camp (which I have done) and since they would go because I am working or looking for work, I just need to submit those receipts.

Yes, her ssn is fine. Your company will provide you with the paperwork to fill out. However, you are not allowed to use daycare costs just for the heck of it. Daycare is only tax deductible to you when you are working or looking for a job. I've had people tell me that even being sick, laid up in the hospital was not acceptable to the IRS. They would not allow the money to be deducted because the parent wasn't working.

In regard to what an earlier responder said....Unlicensed daycare providers do this ALL the time. Really, I get so tired of hearing people say such stupid things about unlicensed caregivers being unable to...fill in the blank. I've been unlicensed for the better part of the last 17 years, was licensed before that. It's never been a problem for me to fill out these forms....just make sure that you have a covered expense. You might need to see if taking classes would be okay if just having her there for the heck of it won't.

Sounds like something your company representative would be able to tell you about. That way if you do put their child in child care the provider would have a person's name at the company to call and verify stuff with.

You need to check with your former employer to see if they allow care dates starting with the next day after your resignation. DCAP Accts normally have a cutoff day of your last day of employment. Unless the ER has enacted the use it up rule. For example if your last day was Wednesday but daycare was paid thru Friday your plan will only reimburse you thru Wednesday. You can call your administrator and ask them thru what dates of srvice you can submit charges for. I work for a benefits administrato that handles both Med and DCAP accts
