It depends on how long it will take until your new apartment is ready. In some states you can only have "visitors" for two weeks or less, and if they want to stay more then they have to confirm it with the apartment manager.

If it isnt a long stay then I wouldnt see a problem but if it will be a month or more, then it might be more difficult, and might want to check your states law just to be safe, and also so you are informed and have some knowledge if anyone is to ask you about it.

Like a year or a month? I think it would be called "visiting", right? You can always call the local authorities and ask...better to be proactive than reactive, I think.

UNless you are in other ways unfit no one important is going to care. Don't go looking for trouble, after all, what's worse, staying in a small space with your parents, or raising your son from a box?

It's no one's business how many people live in an apartment...heck we have illegal and legal immigrants sharing homes here - there have been 20 people inside ONE 3 bedroom home...

DO NOT go looking for trouble...You are doing what you can to take care of your son and keep a roof over his head...if you need help financially - seek your local W.'s shelter, your local WIC office and get help there...you might find you are able to get a grant so you can get an apartment ...i don't know.

Ask the Landlord.

My friend, who lives in a condo, has neighbors, a family with 3 kids, who live in a 1 bedroom space.
Who knows, what the legality is.
Or if anyone complained.

your parents need to look at their lease. It will state their how long "guest" can visit (over nights). If you exceed that amount and the landlord finds out, he can give your parents a warning and tell them their guest must move out or they can either raise their rent or evict them.

I know first hand as this just happened to me. My name is only on the lease. The landlord knows my son lives with me (hes 3) in a 1brd. My brother stays periodically to help with his nephew. My place has a garage so i let my brother store some tools because its safer and close to him.

My landlord is under the impression my brother lives here because hes always here and I have some of his belongings in the garage. He told me they feel this is the case and in August my rent will go up $500 and a new lease must be signed. Its legal here in California to do that. Because I breached my lease due to the occupants in the unit (they are not listed as living there). However...in my case, this is all based on an assumption. Therefore no action was taken as I made it VERY clear to them, their assumptions don't justify a rent increase or a new lease.

Again, have your parents look over their lease about "guests"
