Son Hurt at School

I am curious. My son got hurt while at school. His hand was shut in a door and his finger was injured. 911 was called and he was taken by ambulence to the ER. Luckily he is going to be fine.
I was curious if the school has any liability or if I should just assume that the entire medical bill lies in our hands.
He goes to a small private preschool and I am uneasy to ask the director ... I don't want to come across demanding as I know the incident was an accident.
If anyone has any insight, I would love to hear it :-)

I was asst director at a private preschool/kindergarten place and we paid for all medical exp. Now everything submitted was after ins and we paid co pays, extra costs and any prescriptions. If you are at a daycare/preschool any of that whether private or not remember it is suppose to be reported to the state as well. I would def ask for compensation. He was in their "care"

I'm going through this right now. The end of my son's finger was amputated in an accident at school. I started with my insurance company and they advised me they would be filing a claim with the school district to be reimbursed for their expenses. I will probably also file a claim to be reimbursed for my out of pocket as well. I would recommend you call your insurance company first and go from there.

If you know it was truly an accident and not negligence on their part, which it sounds like it was an accident, then I say they are not liable for the medical bills. As much as it stinks to have to incur all of those bills I think you have to just bite the bullet.

Glad to hear your son was ok, poor guy a ride in an ambulance and everything =(

The school is 100% liable for the ambulance bill. They all must have insurance to cover these things. You will have to use your insurance for the costs, and anything left over is their responcibility.

I would say most of the time no... it is your insurance that pays.

However, you should not feel bad asking. You can approach the subject like: "I just need to ask, because they asked me at the ER when we told them it was an accident, if you have insurance to cover this or a portion of it."

It's not demanding or assuming that they should pay, but an inquiry as to whether they have some sort of insurance to cover accidents that happen on their property.

If you have medical insurance either private, through work or, through the state, call you carrier tell them what happened. Your insurance provider will work it out from there with the school's insurance. Its part of their job. Beaware that if you receive compensation from the school you are required to give the amount of money you are given to your carrier if it exceeds the amount of what your provider actually paid in negotiated fees, then you may keep the change.

I would agree. If schools paid for every injury kids get they would be put out of business. They have to be very careful because some people are money hungry and would sue over anything. Im not talking about you of course, but just certain people would. I hope your little man feels better and im so sorry he had to go through this. Good luck.

legally, it happened on their property, they are absolutely 100% liable for the medical bills. however, if it were me, and i KNEW it was truly just an accident, i would file with my insurance and cover it myself. glad your little one is okay!

oh, and as for signing a release, those don't hold up in court. one cannot excuse oneself from negligence, it's called an exculpatory clause :)

most likely you signed a release upon enrollment stating something like you understand that accidents happen and the you are responsible for the med bills...we could not afford to stay in business otherwise...
