Car Accident.. Not Sure What to Do?

A few weeks ago an 18 yr old unlicensed punk slammed into me while I was stopped at a traffic light. Witness report is that he was speeding past cars behind me swerving in and out of moderate traffic. As soon as he hit me, another car pulled over to get out and help but before she got out, he backed up into her and then sped off.

Long story short: I am okay, thank goodness, my car is totaled, police caught the guy, and the owner of the car (not the driver) has insurance. The car owner's insurance is paying up so far.

I have not ever been in a wreck like this.

So now my question is: What are my options against this punk? Every time I think about it I think that he is probably driving around again like a free bird and the car owner will just get new insurance, as I imagine her current insur. dropped her, and life will go on for them. Where is the justice??? While I am not majorly hurt, it was our family vehicle that was totaled and we are not in the market to buy a new/used car. It has been a pain in the butt to go to the chiropractor 3 times a week with working around my p/t work and 2 little children who I have to find someone to watch. Not to mention I have been extremely physically tired due to the whiplash injury. It just doesn't seem right for it to end with them just paying for my dr. bills and paying what they think is fair for my car.

What are my options? What would you do? What can I do?? Any advice is appreciated!!!

I saw your last post about this regarding a minivan/SUV. First of all, I am glad you are ok and will be ok.

You do need to contact an attorney. The kid needs some help (as in arrest or punitive punishment)

My husband was injured 12 yrs ago by a driver who walked away. GEES...........Why do the the drivers (cause of accident) walk away from these accidents? Hubby was in ICU, we had a 3 month old baby, I had just gotten out of surgery on top of that. To this day, he has residual issues from this accident. You NEED to find someone that will follow through for you on the case. I do not know an attorney to recommend but please find one.

Keep in mind, you are not finding an attorney to "get the guy" You are finding one to help make sure that your injuries are properly evaluated so that you have an idea of how long you will endure any pain, rehab, etc.

I personally, have a hubby who is a workhourse and he went thru rehab with no surgery to get better as fast as possible.

M....Act fast. My stepson's house was hit by a young guy with no insurance. It cost them the tenants that were living there, 6 months of no rent and $40,000 to repair the house! No charges were made against this kid and he was taken to the hospital because he was hurt and that was the last they heard of it. If they had jumped on it sooner rather than waiting to hear back from him they may have had some recourse.

Well, I would contact the police department and find out what happened to the driver. Surely he was charged with hit and run and wreckless driving. Don't know what the punishment is for all of that. I suppose you could sue the driver of the vehicle but you'd need a lawyer to tell you if that's worth it or not. See if you can find an attorney who might be willing to consult with you at no charge or for a reduced fee just to see if you have anything worth fighting for. There are some nonprofit attorneys who will do this. Or, call someone like Jim Adler & Associates or Brian Loncar. I see their ads all the time. They might be able to help you.

M., you should hire an attorney to explain your options to you and ensure your interests are taken care of. Generally one who is hurt in a wreck can seek to recover damages beyond a refund of doctor bills. You need to be careful that you do not sign anything until you have it reviewed by an attorney. I do not happen to know any "good" personal injury attorneys but would be glad to get a reference for you if you ask. I am a tax attorney. I was in a similar wreck more than 20 years ago; totaled my six month old car, ruined my back and neck for the rest of my life. I was a college student and could not afford to pay off the debt on the car with the money I could get for the auto damage. The one who hit me had no insurance, no money, no job, of course. Try to focus on the fact that you are alive and your children are unhurt and hire an attorney to help you sort out the legal issues with your damages.
