Free or Cheaper Legal Aid for Custody

Im gonna sum up my back story. M husband and I live in PA, we have 2 daughters and a son on his way. We seperated a few weeks ago and want to get divorced. My kids and I moved to MI to live with my parents. My husband has gone into a life of drugs and drinking so that is why we left. He is paying me child support for our kids. My queastion is on custody issues. My husband said he isnt going to fight me for custody, he just wants visitation. My concern is if I dont get it legally and in writing can he force me to take the kids back to PA and if he just showed up here for the kids can I stop him from taking them back to PA? I want my kids and their dad to have a relationship but I dont want him to be able to take them back to PA for a vist because of the drug use. Again I dont think for a second he would try anything but when people are on drugs they do stupid stuff. So if anybody can tell me how to find free legal aid in Saginaw MI or even a lawyer on a sliding scale I would greatly appreciate it. Thanks so much!

I would call legal aid. I have lots of family over there and live about a half hour from you. If your husband is into bad haits-such as drugs S., don`t let the kids go with him. I went through the same thing when my daughter was little, and she was put in a really bad situation! She was only 3 and he only had visitation for 4 hours on Saturdays, my mom was the one to pick her up and take her, she called over there to tell him she would be about 15 min. late, and my daughter answered the phone saying daddy won`t wake up! He took too many pills, and had a cig. burnt all the way down! while still holding it! I gave him 2 years worth of chances to get her when ever he wanted, and for nights, but the chances had to come to an end because of his bad habits and me protecting my daughter. I always wanted her to have a relationship with him too, but drugs and alcohol took over. He died 7 yrs. ago now, because of his choices, so be careful.

I think you can just file for sole custody, sole possession of the children. It sounds like you have a legitimate reason. I don't know what kind of proof or verification the court might need.

I went through a similar situation, but I had never marriedmy daughter's father. Call or go to Friend of the Court.

Many legal firms offer free phone consultation. I would definitely get going on this because under the influence, he may not realize what stunts he can pull. Not to mention that "friends" and family of his might put other ideas in his head. Better to get things settled legally.

You might contact a local women's shelter in the area. They probably deal with these issues all the time and could give you good advice. I think you absolutely need the custody and visitation in writing. Are your parents able to help you? So sorry to hear about your situation...all the best!
