How Can I Check My Son Father License Status Is No Longer Suspended

My son father license was suspended before he had visitaion. He said it was already fixed so now it back to valid. But now he has visiotaion right. How can I check to verify that he is telling the truth?

EDIT***The reason I ask is because. When we went to court I specially had the judge make it a condition of the visitation for only a person with a valid license be able to drive my son around. Because I already knew his father had a problem with that once before and of course he agrees since I do not have a license or a car. In the beginning his girlfriend would be the one driving when he would pick my son up. But now she doesn’t so it something I want to know if I can find out myself, without getting in to an arguments with him questioning him.

Umm...if you have his DL#, you may be able to run his record through the DMV kiosk. We have one at our convenience store where we are also able to register our plates and get a smog check. Look and see if there is one available in your area. We are able to get a driving record at the kiosk, the one that you supply your employers.

Otherwise, call DMV and ask, who knows what is public information until you ask.

And last, court order.

DMV information is not available to the public, at least not in CA. It used to be until stalkers used DMV to get residential information on their victims!

You can call the DMV and see if that information is available, but you might need his driver's license number for them to check, if it is available to the public. Other than that, there is no way to know.

You can ask him to provide a driving record. It will state when the license was reinstated.

If he gets a ticket for driving with a suspended license then HE pays the fine. It doesn't affect you or your child at all. I'm pretty sure the DMV doesn't share peoples' personal information with anyone other than law enforcement (at least I hope they don't!)

You could try to call the court and speak to someone there or you could try your local police department's non-emergency number and see if they can direct you to someone who can help. Not sure if anyone can/will give you the info you're looking for, but it's worth a try. Good luck!

Ask him to provide it. It's a valid request that your son only be driven with a person who has a valid license, it the burden of proof is on your ex.

I know you don't want your child to go with him if it's suspended but I don't think you have any legal right to force him to supply you with anything. You would have to ask a judge to order him to provide the court with a copy of a valid drivers license. They have the legal right to make him do anything. You however don't.

If he has court ordered visitation you cannot keep your son from going with him. All he has to do is call the police and tell them he has a court order for you to surrender your child to him for visitation. They can actually come in your home and take your son away from you and give him to the ex, even if you say no, they can't even make him produce a valid drivers license if you say you think that he doesn't have one. He has a court order, a judge has given him the right to have the child and there's nothing you can do when he comes to get him. The police can decide to not make him go if they suspect the ex is under the influence while standing there, they can decide to do anything they want but if they have no valid reason for doing it they can get in trouble.

My daughter had to routinely call the police to get her son from her ex. They would go over and stand there while her ex ranted and raved about her being unfit and not having any food for the baby. They would tell him she had a court order and if he felt the child was in danger he could call child welfare while the child was in her care. They would investigate while he was there and if they found cause they would remove the child from her care and bring him home. They never found any reason for removing him in all the times they had a referral from the ex.

You can call the police and tell them that you believe your ex is driving without a license but if he's driving without breaking any laws then they can't really stop him. They can't randomly stop people for no valid reason based on anyone's verbal comments. They could be trying to hassle someone and cause them trouble. So the person has to break the law for them to stop them or they have to seriously suspect they are breaking the law, such as driving under the influence or drinking from an open container. They have to have a reason to stop them.

So talk to your attorney, ask him if he can file any sort of paper where the ex would have to supply the court with a copy of a current drivers license. He can ask for more if there are grounds, like drunk driving arrests, drug arrests, etc.....but that is up to the attorney to decide.

Do you have a lawyer? My guess is they could find out as it would affect him being able to drive with your child and your child's well being.
