Apartment Laws

OK, so here's the deal. My husband is graduating this June with his Masters degree. He has been offered a job in the Army and ships to basic training on June 30. After basic training, he has to go to advanced training for at least one month with the slight possibility of three months. That means he could be away for six months! After he finishes all of his training, we will have just one week to report to wherever he gets stationed at, probably Virginia, New York or Germany. For this reason we've decided to put in our notice at the house we rent and get a small apartment while he's away. That way, we won't have to pack up and clean an entire house in one week. We'd much rather spend that time getting the kids used to him again and just having family time. We don't want to stress about a big move during that time. The plan is to put about 80% of our stuff in storage and just move the basic necessities into the apartment. I also plan to spend a lot of time with friends and family while he's gone to keep my mind off of missing him, so I don't see us spending that much time at the apartment. We'd like to save as much of his housing stipend as possible, so we were thinking of getting just a one bedroom, putting our boys in the bedroom and our bed in the living room. The problem is, we're not sure if this is against Kansas' zoning laws or anything. My question is this: Does anyone know if we would be required to rent a two bedroom, or could we just do a one bedroom since it will only be me and my sons? I'm having trouble finding state of Kansas specific information on this issue. Your help is appreciated!

What can I do next?

I know this response is delayed and I apologize. You need to look at small complex or and individual that will not force you into a 1 year contract. Also having moved twice overseas with the military, if you have stuff in 2 locations they may not pick it up there for you. Be sure you ask questions when you arrange your move and make sure they put down that your stuff is in 2 locations.
I know of people in a 2 bedroom 3level condo type that have their own bed and baby crib in living room and the 2 kids in the other 2 rooms. I never know how "legal" anything anyone does, once they rent a place they do whatever they want to do. Good luck to you in your upcoming adventures, R.

Never heard of any laws governing this. Your only problem might to getting an the apt complex you'd like to live in to rent to you under those circumstances. Sometimes when you have more people in a space than is considered practical, things are more likely to be torn up or damaged. However, I'm sure you can find some place to rent a one BR to you, especially if you have a good rental record.

Good Morning T., I believe a 1 bedroom would be just fine. There are the studio apartments where you have ONE room only, usually pull outs beds or sofa sleepers. I know more then one person with children have lived in those.

A one bedroom apartment will be fine I am sure. There is no law or rule that says each people has to have their own bedroom. What side of Wichita are you wanting to live on?
Do a google apartment search to help you. Then call the complex and ask questions, letting them know after June it will be just you and the children for possibly 6-8 month period while hubby is in training, then relocating out of state. One thing though you may run into is the lease or rental contracts. Most want renters for at least one year. So that is something you may have to see if they are willing to work with you on.

My sis is law is receptionist / get it done girl..lol for Caldwell banker dinning beard on E. 13th if you like I can call her and see if she knows of anything that would cause you problems. Even see if they might have rentals or know of some.

Also T. you could go a head and stay where you are and still store your belongings. Sort, throw and store. Get it down the the bare minimum. Wouldn't take much to pack up everything then and take to new state, since you know basically the time frame you are looking at.

God Bless hope it all works wonderfull well for you and your family

PS Tiff sometimes when you relocate the company / military hubby is employed with will do the packing and loading and moving your household for you. We've done this twice with Boeing.

The last time I checked into this was several years ago, but at that time, laws in Wichita would have required you to rent a 2 bedroom. A friend of mine was in a similar situation. Her husband was going into Army training for several months. At the time they had one son. She and her son stayed in the one bedroom while daddy was gone, but as soon as he came back they had to move to a 2 bedroom. One way around that might be to rent from somewhere other than a large complex. They might be more amenable to your situation.
