Custody and Child Support

I'm actually looking for help for one of my friends who is in a tough situation. She has a 2 year old little boy with a guy she left her husband for. They moved in together and she quit her job to stay home with her two older daughters and their new son. Well, he is in complete control of everything especially money and he seems to be trying to drive her away (even though she obviously can't go anywhere without some money!). Basically, them separating is inevitable, they've even talked about it a little. He says that he is going to have 50/50 custody of their son, who he rarely has time for and wouldn't even give her money to buy birthday presents for. I believe he is trying to avoid paying her any sort of child support. Obviously, she needs to get back to work, but with joint custody like that will he still pay her some support? He has his own business and makes much more than she did when she was working. Does anyone know a good place to call for advice on this? She has no access to money except when he writes her a check to buy groceries so free would be wonderful!

I wanted to thank you all for your help! I'm going to give her the information I was able to gather, thanks to you, this week and hopefully it will give her a little hope. I know she's really overwhelmed and this will give her a great place to start!

i got help with my divorce from community legal services...they would help with any paperwork and also help her apply for diferment fees that she would have with the courts....also answer any questions she would have...

I just went through the whole child support thing. You can go to www.azdes.gov and print out the forms to file child support. Then you can go to the DES office and file them for free and they will serve the papers for free and everything. There is not a quick and easy way for this to happen. I filed my papers in june of 06 and after everything was said and done i finaly received my first check in oct 07! The way child support is figured is all mathmatical. they have a worksheet that they plug in all your finantial info and it figures the percentage of what each parent should pay to raise the child. They do give credit for the time spent with the child. there is a place on the azdes website that you can plug in your info into the actual worksheet they use and it will tell you apporox how much child support your or the other party is responsible for. Hope this helps!

city of phoenix, ###-###-#### offers a 30-minute free consultation with a family lawyer regarding legal issues including child custody etc....I actually met with one of their lawyers and it was very helpful....hope that helps...Ask how you can schedule the appt for the volunteer lawyer? If your friend is low-income, she won't have to pay anything....There is usually a wait involved once you get there....It's located somewhere near 201 W. Jefferson/Washington, Downtown phoenix....

Hi S.,
I believe with custody stuff-even with joint 50/50 custody whom ever makes the most money between the two with have to pay the other an amount unless agreed upon. I would call a lawyer who does free consultation and sometimes over the phone they will give you basic advice. In regards to her- she does need to find a job ASAP. Even with her having no money, the best thing that it sounds like she can do right now is possibly stay with someone for a little while- if it is that bad in the household it is not a good thing for the kids. I hope for the best for your friend.
