my daughters sister in law is getting a divorce. Today they had their first hearing. The magistrate ordered her to pay $600 MONTH and 1/2 of daycare. This just doesn't sound right. She makes $60,000 per year and he makes $45,000 per year. Not Joint custody. They have been married for 6 years. There was no talk of child support. There is another hearing April 24. What do you all think?

The daughter is 3. I think they are doing visitation but not joint custody

Questions: who is getting custody of the children? how many children? how old are the children? if this isn't child support, is it spousal maintenance? if there are more hearings, is this a temporary order? does she have a competent lawyer? does OH have a child support calculator (MN does and it is available online)?

Custody, child support, allimony and parenting time (or visitation) are all different things. There isn't enough detail to comment on here. Like how many hours is the kid with each parent? That factors into cost. Also, who is paying for health care and other factors? From our vast experience in court hearings for custody, you cant assume ANYTHING because ANYTHING is likely to happen. Yep, the tide is turning. They judges are favoring men more and more. My friend just got orders to pay nearly $400 per month in child support to her hubby and she has been a SAHM for 13 years and has no formal education. I cannot believe this judge did this to her. The hubby makes over $100K per year. He left her and moved in with his girl friend. He is buying the girl friend new appliances and all kinds of stuff he refused to buy for his wife so she could keep the house clean.

It is so unfair for everyone too. I see this happening more and more. It is so sad.

I guess if the children are living as much with their father as they are with their mother, then it makes sense whichever parent makes more would be paying the parent who makes less support.

If the children are living ONLY with their mother, and going to their father's every other weekend....

Or you're saying she's been ordered to pay $600 a month ALIMONY? Spousal support? Yes, that is odd.

There must be more details to this story.

Even so, every divorce situation is different.

The $600 per month is spousal support? I guess that amount will make their monthly incomes almost identical. I assume the spousal support is for a set amount of time, say for a year or so?

It's hard to believe that the magistrate would worry about spousal support and not even address the issue of child support.

It sounds wierd to me, but to be honest almost anything a family law court does is suspicious. They never seem to get it right!

Not enough info to know for sure but its a standard of living agreement which puts them on an even playing field in order to take care of their kids, I just looked this up while trying to figure out how I am going to support my kids when he makes at least 25% more then me
