Hi all. I worked part time as a fitness instructor at a local gym and the director there is refusing to pay me my last paycheck.
I know I can report her to the Dept of Labor, but when I go to the web-site it is SOOOOO confusing.
I live in Mass. Does anyone know how to do this? Thanks!

There should be a phone number on the Department of Labor web site.

What is the reason she is giving for refusing to pay you? Do you owe her anything, i.e. equipment, uniforms, company property. Did you sign any type of contract with her? If so, did you breach the contract? Did she?
As for reporting to the DOL, you can. Also, check your state. There could be a "payday law". There is here in Texas, so I'm thinking there probably is one in Mass as well. FLSA (Fair Labor Standards Act). deals with wages. You should be able to find that under the DOL.

Call them. Document everything. So sorry this is happening! Also, don't tell them you are doing this or anything. Be very professional whenever you speak. Do you know why they are doing this?
Why is she refusing? Is she denying that you worked or is she saying that there was some kind of breach of contract? That might help you get a more specific answer. We've had some cases where we delayed the final paycheck because it was contingent on something (returning equipment or uniforms, etc.). Is it something like that?
Do they have contact info such as a phone number? You could also try calling your local unemployment/job service office and ask if they have a contact number. Or call a local office for your state representitive.
Write everything down so when you call them you can answer all questions in an organized manner.
