Help!! I have searched and searched does anyone remember a post regarding a landlord not repairing an AC. One of the people who responded sent her great information on tennant and landlord rights. I am in a situation where I rented my home out when my husband and I married. We ended up with the worst renters they pay their rent on time however they are very dirty. The city has cited them on several occasions for the items they have in the driveway. The cutest little house in the neighborhood is now the trashiest. My old neighbors are calling me complaining. I asked them to get it cleaned up but they don't. They have ripped the bathroom door off the hinges and then tell me its becasue the screws were to short. We go over to make repairs and the house is a disaster. The front door isn't accessible because they have furniture piled up in front of it. Dirty clothes every where. Ia m worried about fire hazzards and the distruction of my property. We also had to replace ceramic tile in the kitchen floor (standing water)a leak we weren't notified about for 2 weeks. The list goes on and we still have 3 months remaining on lease. It is a NIGHTMARE... I told my husband today lets just cut our loses and sale the house.

Not sure you can do anything right away. You can give them notice - also you might want to look into a management company to manage it in the future. I wish we would have kept my house and rented it. (I bought it for 135K and recently it sold for 359K a mere 5 years after I purchased it.) Good Luck. If you want a management company recommendation I will find out the one my brother in law uses for you.

I was a landlord, leasing a house for about 5 years and went thrugh some of that and more...even went as far as going thru the eviction process in court. I finally learned how to find a good tenant which, in the end, made it worthwhile. My opinion of your situation is to start NOW getting them out of your house. The sooner the better; they will never be good tenants and clearly the damage will probably only get worse. First look at the lease agreement that you had them sign and see if they are in violation of any of it. Hopefully you spelled out explicit terms the tenants must abide by regarding the condition of the place. If they are in violation of any part of that lease agreement, mail them a certified, return receipt letter saying they are in violation of the contract. You could tell them they have x days to correct the matter(s) or you could tell them they must vacate the property immediately (that would be an eviction notice). Evicting people like that isn't always easy. Also, just because their lease is up in 3mo doesnt mean they'll leave. You still need to follow legal procedure to cya. Whether you decide to sell or re-lease, you still have to get rid of those people first so you can make repairs. If you decide to get new tenants, I'll give you the lease agreement I developed and used. I'll gladly pass to you the tips, the warnings, the wisdom I gained. My husband is an attorney and he advised that you seek an attorney and also stated, "that your rights are defined by the lease and any notice provisions, default conditions, and rights to possession and termination of the lease should be spelled out explicitly in the lease. Otherwise if it is not contained in the lease you will need a lawyer to explain the relevant statutory law and procedure for dealing with non-rent based defaults, i.e. 'trashing the house.'" Sorry for the headache. Hope it all works outs. Let me know if you need a referral for an attorney.
