Several months ago I sought advice regarding my serious issues at work. Now they have finally terminated me ( they had systematically taken all my work assignments away, given me instead a menial, brainless temporary assingmnet, and once it was over told me they no longer needed me. The entire time I was grossly mistreated and subject to rules made up for only me), & of course had no valid reason, there was nothing I had done wrong as far as my performance. I had never been written up in 12 years, & always hd very good reviews. My boss and her stable of brown-nosers simply did not like me, and I think they resented me for being black, and for having several dibilitating illnesses. Sad, but I am sharing this so you can better know the kind of attorney I will need. Have you used some attorney in the Dallas-Ft Worth area who REALLY knew his/her stuff??? I realize Texas is a 'right to work' state, but I have to have some rights in this.Surely aperson cannot be abused for the color of thier skin and because they have disabillties due to failing health (I became obese due to medication, hd difficulty walking, suffered from chronic fatigue and severe muscle and joint pain, & although I did not allow ths to affect my performance or disposition, visually it was clear.

What can I do next?

Yes she is right you will have to have clear proof, w/names dates and witnessess emails voicemails or something. But there is an Attorney in my office that does wrongful termination cases. He will give you very brief consultation over the phone but if you come into the office and meet w/him he charges a consultation fee. But I've notice his consultations are VERY thorough and can last several hours. I do not work for him, I work for a different atty in our office but he has alot of experience and is very intelligent and seems to know his stuff. Plus he represents the ACLU so he would be very informed on race issues I would imagine. His name is Frank Colosi he is downtown Fort Worth. ###-###-####. Just call and leave him a message and he will call you back. He does not have a secretary. God Bless you I pray you find relief and/or a new and even better job at the very least!

Since I am not from your area I can't advise on a specific attorney. But you could call the state labor relations board, if nothing else call job service and ask them for the number. If nothing else you can file a complaint.
I doubt if you have much of a case. But it is worth a shot. Remember in court it is not what you know but what you can prove. If you have nothing writing and no witnesses it's gonna be difficult to prove any kind of discrimanation. I'm not saying it didn't happen but can you prove it?

Since you live in a right to work state either party can terminate employment without cause. You could do the same thing to your employer by walking in an saying today is my last day without warning or cause. With that being said if the employer made mention of your race, gender or age that would warrant the retainment of an Attorney. The reason that I know this is I worked for the Dallas Cowboys during the season from 1998-2006. I was never late and got great reviews from the people that I took care of during the game. I worked in the press box for 7 years and the visiting owners suite for 1 year. In my last year I recently moved from North Dallas to McKinney and at the first game of the regular season I realized that I was going to be late by the stadiums standards. I called to let my supervisor know and was told that I as long as I made it by 5:30 I would be fine, the game did not start till 7:30. It was pouring rain but I made it by 5:10 I signed in and was told that I was fired. The next day I called a Labor and Employment Attorney. Did I mention that I work in the legal field as a recruiter anyway he told me that unless they made reference to my age, gender or race there was nothing that I could do. As the first person said unless you can prove it there is not a lot you can do, even more so if they have record of you being late or home sick a lot. I know that you have health issues but they could use those as a reason to release you. That is the good and bad about being in a right to work state.

Susan is one of the nicest people you will ever meet, EXCEPT if you happen to be on the opposing side in the Courtroom. She is outstanding.
