Tammi use to drugs in their past, they use to lie in the past, now CPS has been called years later because a family friend got into a fight with Tammi and the Family friend was living with Tammi (the family friend was not paying any bills), the family friend had utilities in there name and had the power shut off at Tammi place then called CPS reporting that Tammi does such n such and told neglecting their own child, and is doing drugs, but yet the family does not know for sure if Tammi is doing drugs. The family friend wanted to get revenge on Tammi because of being kicked out. Tammi took a drug test and passed with flying colors, If the power turned back on Tammi's child is allowed to go back home would you let Tammi who used to use drugs in the past or maybe still using would you let them take the child back?
Ok so the person I am using is as Tammi is my sister, she had our family friend living with her they got into an arugement, my sister kicked her out and the family friend decided to get all pissed off and called CPS, CPS will let my sister have the child back after the power is back on, she is allowed to come get her daughter anytime she wants and keep her permenatly at home, but in CPS interest it is best for her to be here with me so she can have cool air and not be to hot, her daughter is 2yrs old. CPS did a home visit at my place and in the my neice's best interest that she stays with me till the power is back on.

If she has turned over a new leaf and does not do drugs anymore, of course she should have her child back!
It is a bit hard to follow, however in these situations CPS does an investigation ... I hope the best thing for all happens.
This is a CPS decision. If they say child can go back when power is turned back on then you cannot make them make a different decision. If you know and have proof that Tammi is using drugs then you should give that info to CPS. That would be a good reason for the child to not go back home. But you said Tammi used in the past and family doesn't know if she's using now. CPS has the responsibility to investigate before returning the child. They won't keep her away based on maybe.
The reason you gave, of child being cooler and out of the heat at your house is not a reason for you to keep her.
I suggest you need to stay out of it, unless you have verifiable information, and let CPS make the decision.
Who is Tammi? Who is the family friend? How are they related to you?
Your post is very hard to follow and confusing with the names and family plot is hard understand. How old is the child too?
And who would let whom take the child back?
Ok, I am confused by your post. But if I understand correctly,----I would not let Tammi have the child back until she is clean and sober and has her life together. If she is doing what she is supposed to, then she can increase her visits with her kids etc. But if she is still using, NO.

Before I post my answer I have two questions : 1) Is the home they are living in Tammi's or the friends? 2) Was this just the friend getting revenge on Tammi because she was mad about the fight? (and if that can be proven if that was the case then 'friend' ((who isn't really-you can argue with your friend without ruining their life. Tammi will now have a permanent file. Even when Cps 'closes' case at least where I live they still maintain a file)) can be charged with false reporting
If she passed with flying colors it sounds like Tammi is still clean and has been for a bit.

I know some stuff shows up much later even after you quit so I would think if she was, she wouldn't have passed?
I agree with ReverandRuby. It seems like there might be more and pertinent information that would give insight into whether it would be appropriate for the child to return home(?). Not just whether the power is turned back on.
Yes. The drugs were used in the past, if they are no longer using, and that's the only thing that is questionable, there is no reason for the child to be taken from the home. If there is any question of drug use, a simple urine test will tell.
After reading your reworded question and update, I still think that as long as Tammi passed the drug test, there is no reason why the child should not be returned to the home (unless there is other information missing). Just the fact that it would be "cooler" or more comfortable in your home has no bearing on anything. Our school systems sees nothing wrong with having our kids in a 95 degree classroom, so I'm sure your neice/nephew will be just fine.
